These terms and conditions govern your use of our mobile application and any related services provided by us. 1. Eligibility

1.1 You confirm that you have a/any/all relevant/valid license(s) as required by the relevant authorities in Kenya to operate as a tour guide, driver, operator, or in any applicable capacity, at all times of use. You also agree to update and provide these details before any use of the platform, whether required, prompted, or not. You represent that you are at least 18 years old.

2. Use of Application

2.1 Intended Use: The application is intended for use by tour/safari drivers who are critical stakeholders in the industry. They:
– Are the face of the industry, spending significant time with park visitors and in protected areas.
– Spend significant amounts of time in multiple protected areas, gaining broad knowledge and experience.
– Are ambitious, hardworking individuals who contribute significantly to the industry.

2.2 Application Purpose: Our application is designed to:
– Enhance the experiences of tour/safari drivers and guides by providing tools to enrich wildlife observation, support conservation efforts, and improve visitor experiences.
– Encourage active participation in wildlife conservation through features like “see more, save more,” allowing users to contribute positively to the protection of wildlife and their habitats.

2.3 Responsible Use: You commit to integrity, upholding laws, conservation, and anti-poaching efforts while using the application. You also confirm that if you are using this application in a protected area, you have paid all required dues and fees to the relevant authorities/protected area management entity.

3. User Conduct

3.1 Professional Conduct: Users agree to conduct themselves in a professional manner at all times while using the Safari Driver platform, adhering to ethical standards set forth by relevant authorities and professional associations.

4. Liability

4.1 Company’s Responsibility: The Company shall not be liable for:
– Any damages, liabilities, or losses arising from the use of the application.
– Any criminal offences committed using the application under the Kenya Wildlife Act, Tourism Act, or any other applicable law.

5. Mitigation Measures

5.1 Access Restrictions: Access to features such as “recent sightings” in the application are limited to hours when protected areas are open. Other features may be accessible at all times.

5.2 User Compliance: By using the application, users agree to:
– Comply with all relevant laws, regulations, and acts pertaining to wildlife protection and conservation.
– Abide by the wildlife regulations and acts of the Republic of Kenya and any other applicable international laws, regulations, or treaties governing wildlife conservation.

5.3 Liability Clause: These terms and conditions include:
– A clause absolving the Company from liability for criminal offences committed using the application.
– A Legal Notice emphasizing the importance of wildlife protection and penalties for offences under the Wildlife Act shall be provided within the application.

6. Reporting Feature

6.1 Reporting Process: Users consent to report any suspicious activity or signs of poaching to the Company and relevant authorities via email (report@safari-driver.com) or in-app.

7. Privacy Policy

7.1 Privacy Policy Consent: By using the application, you consent to the collection, use, and sharing of your personal information as described in our privacy policy.

8. Mobile Money Payments

8.1 Payment Confirmation: By providing your phone number in the application, you confirm that any and all mobile money payments can be made to this number, and the Company will not be liable for loss or mispayments made to this number.

9. Foreign Exchange Rates

9.1 Indicative Rates: FX rates provided within the application are indicative only. The Company shall not be liable for any discrepancies or losses resulting from reliance on these rates.

10. Modifications to Application Features

10.1 Feature Changes: The Company reserves the right to modify, add, or remove features within the application, including but not limited to point and reward systems, without prior notice. Such changes may occur to enhance user experience, address technical issues, or improve overall functionality.

11. Abuse of Platform

11.1 Prohibited Actions: Users are prohibited from engaging in any activity that may abuse or manipulate the platform, including but not limited to:
– Submitting multiple fake or rejected spots intentionally.
– Attempting to manipulate the system to gain unfair advantages or rewards.

11.2 Consequences: Any user found engaging in abusive behavior as outlined in clause 11.1 will have their account deleted, and any accrued points or rewards will be forfeited.

12. Content Submission Guidelines

12.1 Inappropriate Content: Users are strictly prohibited from submitting any content that is inappropriate, sensitive, pornographic, or violates the rights of others.

12.2 Consequences: Submission of inappropriate content, as outlined in clause 12.1, will result in immediate deletion of the user’s account, forfeiture of any accrued points or rewards, and may be reported to relevant authorities or bodies where necessary.

13. No Claims

Users agree that they will make no claims for any payment, or compensation of any kind if the company uses data they submit on the application for other purposes, whether commercial or not.

14. Termination

14.1 Termination Clause: The Company reserves the right to terminate or suspend access to the application at any time, without prior notice or liability, for any reason, including but not limited to breach of these terms and conditions or suspected misuse of the application.

15. Governing Law

15.1 Jurisdiction: These terms and conditions shall be governed by and construed in accordance with the laws of Kenya. Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Kenya.

16. Severability

16.1 Severability Clause: If any provision of these terms and conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

17.1 Entire Agreement: These terms and conditions constitute the entire agreement between the user and the Company regarding the use of the application, superseding any prior agreements or understandings, whether written or oral.
